dc.description.abstractCílem této diplomové práce je přiblížit pojem lidských práv, jejich ústavní zakotvení a především jejich ochranu. V této souvislosti, jak ostatně vyplývá již z názvu práce, je podrobnější zaměření na judikaturu Ústavního soudu, která se věnuje právu na spravedlivý proces. Jelikož naprostá většina ústavních stížností se dovolává porušení práva na spravedlivý proces, je právě toto téma jako stěžejní zaměření této práce. Vzhledem k nebývalé šíři tohoto základního práva bych jsem se chtěl zaměřit na jeden z aspektů práva na spravedlivý proces, a to konkrétně na problematiku řízení o ústavních stížností fyzických osob v trestněprávních věcech a nálezu Ústavního soudu. Dále bych se chtěl zaměřit na judikaturu Evropského soudu pro lidská práva, který právě velmi citelně ovlivňuje svými rozhodnutími Ústavní soud České republiky a právě na jeho rozhodnutí se velmi značně odvolává český ústavní soud. Dále se v této práci bude věnována pozornost judikatuře Evropského soudu pro lidská práva, který svou judikaturou velmi ovlivňuje rozhodnutí našeho ústavního soudu.cs
dc.description.abstract-translatedAccording to the topic of this diploma thesis, the main aim is to introduce essential jurisprudence of the Constitutional court of the Czech Republic regarding the right to a fair trial, as one of the fundamental right which is contained in Charter of Fundamental Rights and Freedoms. This right also results from the jurisprudence of the European court of Human Rights and the court decisions are based on the Article 6 of the European Convention on Human Rights and Fundamental Freedoms. The diploma thesis also deals with the Charter of Fundamental Rights and Freedoms which provides subjective basic human rights that are guaranteed by the Constitution of the Czech Republic. The following chapter briefly describes the right to a fair trial. Next part of the diploma thesis deals with the Constitutional Court of the Czech Republic which guarantees the right to a fair trial, with its history, organization, competences and with the proceedings before the Constitutional Court which differs from the ordinary proceedings under other legislation. Next, I focused on the chapter 5 of the Chapter of Fundamental Rights and Freedoms which significantly influenced the right to a fair trial and on the European court of Human Rights and its jurisprudence under the Article 6 of the European Convention on Human Rights and Freedoms.en
