dc.description.abstractTématem rigorózní práce je "Vazba v českém trestním právu". Současná právní úprava trestního institutu vazby byla zavedena zákonem č. 141/1961 Sb., o trestním řízení soudním, který byl do současné doby již 100x novelizován. Účelem vazby, coby zajišťovacího opatření, je zajištění obviněného pro účely trestního řízení s plným respektováním základních lidských práv a svobod. Druhá kapitola obsahuje historický exkurz do právní úpravy vazby. Třetí kapitola se zaměřuje na existenci a dodržování základních lidských práv v souvislosti s omezením osobní svobody. Čtvrtá kapitola se zabývá aktuální právní úpravou institutu vazby v českém trestním právu. Pátá kapitola uvádí čtenáře do poskytování právních služeb obviněnému. V šesté kapitole autorka seznamuje čtenáře s existencí vazebních věznic na území ČR, s životem ve vazbě a s právními předpisy, které výkon vazby upravují. Sedmá kapitola nese název "Trestní institut vazby z pohledu veřejnosti". Osmá kapitola obsahuje srovnání právní úpravy vazby mezi českým a slovenským trestním právem.cs
dc.description.abstract-translatedThe topic of this thesis is Detention in the Czech Criminal Procedure Code. The current Criminal Procedure Law no. 141 dates back to the 1961 Criminal Codex and was amended hundred times since then. Detention represents a very serious interference with the constitutionally and internationally guaranteed rights, especially the right for personal freedom, therefore it is essential to follow the law carefully. The second chapter presents a historical overview of detention legislation. The third chapter focuses on fundamental human rights and adherence to them in relation to personal freedom right restriction when using detention as a security precaution. Chapter four systematically presents the detention law in the current Czech Criminal Procedure Code. Chapter five looks at legal services provided for the detained person. In chapter six the authoress appraises the readers with existing remand prisons in the Czech Republic, life in a custody and law regulations dealing with detention. Title of chapter seven is: Detention as viewed by the general public. Chapter eight compares the detention legislation of Czech and Slovak Criminal Law Codes.en
