dc.description.abstractPráce pojednává o materiálním ohnisku ústavnosti, které je zakotveno v čl. 9 odst. 2 a 3 Ústavy ČR jako absolutní zákaz změny tzv. podstatných náležitostí demokratického právního státu. Dále se obsah práce zaměřuje na pravomoc Ústavního soudu České republiky rušit ústavní zákony, která je spojena s kauzou poslance M. Melčáka. Závěr je věnován vybraným náležitostem demokratického právního státu.cs
dc.description.abstract-translatedThis thesis aims to describe the substantive heart of the constitution, which is enshrined in Article 9, Subsection 2 and 3 of the Constitution of the Czech Republic, prohibiting any alteration of fundamental characteristics of a democratic legal state. Subsequently the thesis focuces on the competences of the Constitutional Court of The Czech republic interfere a valid force of constitutional law, which is associated with the case of M. Melčák, MP. In conclusion are discussed selected issues as fundamental characteristics of a democratic legal state.en
