80 let od druhé československé měnové reformy

Abstract

Článek se zaobírá právními i jinými aspekty a dopady měnové reformy provedené v roce 1945, jejíž nutnost byla vyvolána koncem druhé světové války a potřebou obnovit v zemi hospodářský systém založený na oběhu zákonných platidel, o jejichž platnosti by nepanovaly žádné pochybnosti. Zmíněnou reformu, od jejíhož provedení v letošním roce uplyne 80 let, zasazuje článek do kontextu měnové reformy provedené v Československu v roce 1919 po skončení první světové války a měnové reformy z roku 1953, která souvisela s únorovými událostmi roku 1948. Příspěvek poukazuje na tu skutečnost, že změny státního režimu či významné dějinné události přinesly vždy též změny v oblasti měnové. Dále příspěvek popisuje právní zakotvení měnové reformy z roku 1945 včetně rozboru souvisejících předpisů a konečně také dopady zmíněné reformy do rozhodovací praxe soudů či do obsahu mezinárodních obchodních dohod.

The paper deals with the legal and other aspects and effects of the monetary reform carried out in Czechoslovakia in 1945, the necessity of which was triggered by the end of the Second World War and the need to restore an economic system in the country based on the circulation of legal tender, the validity of which would not be in doubt. This reform, which is 80 years old this year, is set in the context of the monetary reform carried out in Czechoslovakia in 1919 after the end of the First World War, and the monetary reform of 1953, which was linked to the events of February 1948. The paper highlights the fact that changes in the state regime or major historical events have always brought changes in the monetary sphere. Furthermore, the paper describes the legal anchoring of the 1945 currency reform, including an analysis of the related regulations, as well as the impact of the reform on the decisionmaking practice of courts and on the contents of international trade agreements.
