dc.description.abstractPředkládaná rigorózní práce je zaměřena na problematiku Alternativních trestů k trestu odnětí svobody v české právní úpravě. Primárním účelem je nahrazování nepodmíněného trestu odnětí svobody. Rigorózní práce se zaměří na osvětlení problematiky de lege lata, rovněž i de lege ferenda.cs
dc.description.abstract-translatedIn general, it can be concluded that unconditional imprisonment has more likely de-socializing rather than re-socializing effect. For this reason it´s desirable to apply it only "ultima ratio", what means, when it´s the last possible solution. Negative influence of the prison environment is significant factor that affect mental stage of that ones in prison, speaking not only about imprisoners, but Prison Service staff as well. It´s necessary to find new and more effective ways of dealing with perpetrators and try to replace punishments of imprisonment with preferred ones without restriction on freedom. One of the main goals that alternative punishment was supposed to achieve was the elimination of restriction on personal freedom. Imposition of imprisonment in case where alternative punishment shall be more appropriate just helps the perpetrator to adapt more likely in criminal environment. Consequently, these people very often became recidivists committing more and more serious crimes in time.en
