dc.description.abstractHlavním záměrem této práce je analyzovat smluvní odpovědnost dopravce v mezinárodní přepravě zboží různými druhy dopravy. Zvláštní pozornost byla věnována přepravě nákladu po moři pro jeho komplexnost a provázanost s ostatními obchodními sférami (bankovnictví, pojišťovnictví) a protože přeprava zboží po moři jako nejstarší odvětví přepravního průmyslu položila základy pro tvorbu pravidel mezinárodního obchodu. Dalším z cílů této práce je představení subjektů na námořním trhu, jejich obchodních vztahů a právních norem, které je regulují.Stěžejní část práce je porovnání jednotlivých mezinárodních Úmluv (Haagská, Haagsko Visbyská, Hamburská a Rotterdamská pravidla), s důrazem na odpovědnost dopravce. Dále bylo záměrem představit některé konkrétní případy z praxe námořní přepravy, které mohou ovlivnit stav nebo čas doručení zboží a nastínit dopad na odpovědností režim.cs
dc.description.abstract-translatedThe main objective of this work is to analyze and describe the contractual liability of the carrier in international exchange of goods with a different means or ways of transport. Special reference was made to transport of cargo by sea for it´s complexity and merging with another spheres of business like banking and insurance and because the carriage of goods by sea as the oldest branch of transport industry layed down the basis for adoption of the rules of the international trade. The main framework of this thesis is introduction of main subjects of the trade, their commercial relations and main lawfull acts regulating or simplifying their rights and duties. The pivotal analysis of this work is comparison of Hague-Visby, Hamburg and Rotterdam Rules where selected possible subjects to disputes, litigations or suits were examined. Certain aim of this thesis was as well to introduce some examples from praxis of sea tranport which may influence the condition or time of delivery showing any challenges which are possible to encounter in maritime adventures. The conclusion of the work tends to examine implementation of Rotterdam Rules in praxis and their direct or indirect impact on liability regimes.en
