| dc.description.abstract-translated | In the article, we pointed out the legal regulation of the conditions, if fulfilled, it is possible to carry out a shortened legislative procedure on a draft law in the Slovak Republic, if from a time perspective it is objectively impossible to proceed in a standard manner – a state of legislative emergency occurs. We consider the conditions regulated by the Rules of Procedure of the Slovak Parliament to be good, but it is essential that they are also respected. In this context, we have also looked at the case-law of the Constitutional Court, which has repeatedly found that the legal conditions for the adoption of a law in an accelerated procedure have not been met, but that the legislative process in which such a law was debated and approved was not unconstitutional. Based on the processing of statistical data, we have highlighted the development over the last 14 years, which has also become turbulent in the context of the COVID-19 pandemic. However, from 2021 to 2023, there is a decline in the percentage of laws passed in the shortened legislative procedure to the total number of laws passed. In the last chapter, we outlined possible constitutional or legal solutions for the shortened legislative procedure in the future. The accelerated legislative procedure is not a Slovak specific, but the conditions under which it can take place must be strictly observed. | en |
