| dc.description.abstract | Cílem diplomové práce je popsat změny, které nám do právní úpravy přinesl nový zákon o distribuci pojištění a zajištění. Zákon byl do českého právního řádu implementován směrnicí IDD vydanou EU. Přináší hlavní změny v legislativě v oblasti distribuce pojištění. Mění dosavadní kategorie pojišťovacích zprostředkovatelů a jejich registraci. Zákon nově vymezuje čtyři kategorie PZ a jsou jimi samostatný zprostředkovatel, vázaný zástupce, doplňkový pojišťovací zprostředkovatel a pojišťovací zprostředkovatel s domovským členským státem jiným, než je Česká republika. Seznam regulovaných a registrovaných subjektů finančního trhu tzv. REGIS vedený ČNB prošel kompletní proměnou. Původní zapsané údaje o PZ se vymažou a nově se budou zapisovat aktuální údaje. Aktualizace registru ČNB reaguje na další změnu, kterou právní úprava přináší. Jsou to zkoušky odborné způsobilosti. Je kladen veliký důraz na odbornost pojistného trhu, proto subjekty, které zde vystupují musí být odborně způsobilý. Původní osvědčení o odborné způsobilosti bude prozatím postačovat jen po dobu přechodného období. Oprávnění k činnosti PZ získá složením OZ u akreditované osoby. Každý rok si oprávnění bude muset každý PZ obnovovat a to zaplacením správního poplatku. ZDPZ navyšuje informační povinnosti, zpřísňuje pravidla pro jednání se zákazníkem a zavádí novou dokumentaci. | dc.description.abstract-translated | The aim of the diploma thesis is to describe the changes that the new law on the distribution of insurance and reinsurance brought to the legislation. The law was implemented into Czech law by the IDD directive issued by the EU. It brings the main changes in the legislation in the field of insurance distribution. It changes the existing categories of insurance intermediaries and their registration. The law redefines four categories of insurance intermediaries. The list of regulated and registered financial market entities, the so-called REGIS, maintained by the Czech National Bank has undergone a complete transformation. The original entered data on insurance intermediaries will be deleted and the current data will be newly recorded. The update of the register of the Czech National Bank responds to another change brought by the legislation. These are aptitude tests. Great emphasis is placed on the expertise of the insurance market, so the entities that act here must be professionally qualified. For the time being, the original certificate of professional competence will only suffice for a transitional period. The insurance intermediary obtains the right to operate by passing a professional examination with an accredited person. The Distribution Act increases information obligations, tightens the rules for dealing with the customer and introduces new documentation. Finally, I will summarize the current situation affected by the Covid-19 pandemic. | en |
