dc.description.abstractTato diplomová práce pojednává o Úmluvě OSN o smlouvách o mezinárodní koupi zboží (též "Vídeňská úmluva, "Úmluva či zkráceně "CISG), představující jeden z nejdůležitějších unifikovaných nástrojů mezinárodního obchodu. Smluvním stranám, majícím místa podnikání v různých smluvních státech Vídeňské úmluvy, poskytuje potřebný flexibilní rámec pro uzavření kupní smlouvy. Cílem této práce je zdůraznit přínos Vídeňské úmluvy pro mezinárodní obchodní styk. Počínaje úvodem, seznamujícím nás s obsahem práce, se autorka přesouvá k historii mezinárodního obchodu, pokusům o unifikaci kupní smlouvy a vytvoření Vídeňské úmluvy samotné. Dále se zabývá pojmem mezinárodní kupní smlouvy, aplikací, výkladem a klíčovými zásadami Vídeňské úmluvy. Poté se přesouvá ke čtyřem částem Vídeňské úmluvy, které následně doplňuje vhodnou judikaturou. V předposlední části nastiňuje současnou podobu mezinárodního obchodu a otázku budoucího vývoje a role Vídeňské úmluvy, na což plynule navazuje v závěru, v němž shrnuje úlohu Vídeňské úmluvy a směr, jímž se bude pravděpodobně v rámci mezinárodního obchodu v letech budoucích ubírat.cs
dc.description.abstract-translatedThis diploma thesis deals with the UN Convention on Contracts for the International Sale of Goods (also known as the "Vienna Convention, "Convention or "CISG for short), one of the most important unified instruments of international trade. It provides the necessary flexible framework for contracting parties with places of business in different contracting states to the Vienna Convention to conclude a sales contract. The aim of this thesis is to highlight the contribution of the Vienna Convention to international trade. Beginning with an introduction introducing the content of the work, the author moves on to the history of international trade, attempts to unify the contract of sale and the creation of the Vienna Convention itself. Then she discusses the concept of the international sales contract, the application, interpretation and key principles of the Vienna Convention. Then she moves on to the four parts of the Vienna Convention, which she then supplements with appropriate case law. In the penultimate section, she outlines the current shape of international trade and the question of the future development and role of the Vienna Convention, which she seamlessly follows up in the conclusion, summarising the role of the Vienna Convention and the direction it is likely to take in international trade in future years.en
