dc.description.abstract-translatedThis article presents two stances of the Polish Supreme Court regarding the issue of the legal existence of the mortgage that was originally imposed on the real estate of a housing cooperative in the event of ex lege conversion of the right to premises of a cooperative member into separate ownership. Originally, the Supreme Court held the position that in such a situation the holder of this limited proprietary right acquires the property encumbered by the joint mortgage which was previously incumbent on the property of a housing cooperative. In 2019, the Supreme Court changed the previous line of jurisprudence, indicating that the entitled individual acquires the ownership right without the mortgage encumbrances originally incumbent on the real estate of the housing cooperative. In the author’s opinion, the above-mentioned issue is crucial especially due to social issues and for the sake of citizens’ trust in public authority. The author positively evaluates the current stance of the Polish Supreme Court.en
