dc.description.abstractPodstatou diplomové práce je zjištění, že v období osvícenství se vytvářejí základní předpoklady novověkého, moderního práva. Ve vývoji českého práva je osvícenství spojováno s vládou Marie Terezie a Josefa II. kteří v rámci rozvoje zemí, ve kterých vládli, zaváděli četné reformy. Cílem reforem, zaměřených převážně na oblast správy, trestního zákoníku, školství, obchodu, náboženství bylo zlepšit život poddaných a posílit moc státního aparátu na úkor privilegií šlechtického stavu. Vytváření podmínek pro hospodářský rozvoj vedlo ke zrušení bezprostřední osobní závislosti poddaných na vrchnosti, k likvidaci cechovních omezení a celních bariér, zaváděly se jednotné váhy a míry. Náboženská svoboda byla rozšířena na další skupiny věřících, především Židy a protestanty. Člověk získal řadu lidských a občanských práv, které zahájily cestu, na jejímž konci stojí teorie přirozených lidských práv a účelem státu bylo, výměnou za postoupení určité svobody, zajistit těmto přirozeným právům ochranu.cs
dc.description.abstract-translatedThe essence of the diploma thesis is the ascertainment that in the period of the Enlightenment the basic assumptions of modern, contemporary law are created. In the development of Czech law, the Enlightenment is associated with the government of Maria Theresa and Joseph II. who have introduced numerous reforms in the framework of the development of the countries in which they ruled. Their reforms aimed mainly at governance, the criminal code, education, trade and religion but were also aimed to improve the lives of the serfs and strengthen the power of the state apparatus to the detriment of the nobles' privileges. The creation of conditions for economic development has led to the abolition of direct personal dependence of serfs to the nobility, the elimination of material restrictions and tariff barriers, the introduction of a uniform weight and measure. Religious freedom has been extended to other groups of believers, especially Jews and Protestants. Man has acquired a number of human and civil rights that have begun a journey which ending the theory of natural human rights, and the purpose of the state was, in exchange for the transfer of a certain freedom, to ensure the protection of these natural rights.en
