| dc.description.abstract | Jak již vyplývá ze samotného názvu tato diplomová práce pojednává o ochraně majetku ve světle judikatury Ústavního soudu ČR a Evropského soudu pro lidská práva. Celý obsah práce je rozdělen do čtyř kapitol. První kapitola blíže vymezuje pojem ochrany majetku a jeho právní zakotvení jak na vnitrostátní, tak mezinárodní úrovni. Druhá kapitola se zabývá Ústavním soudem ČR jako takovým, řízením před Ústavním soudem a následně judikaturou týkající se ochrany majetku. Třetí kapitola je věnována Evropskému soudu pro lidská práva, řízení před Evropským soudem pro lidská práva a poté judikatuře týkající se ochrany majetku z pohledu Evropského soudu pro lidská práva. Čtvrtá, poslední kapitola obsahuje komparaci pohledů obou výše uvedených lidskoprávních institucí na pojem ochrany majetku. Cílem této práce je zaměření se na rozhodnutí ÚS ČR a ESLP v soudní praxi. Sekundárním cílem je popis ochrany majetku v právních předpisech a porovnání přístupu obou soudů k tomuto tématu. | cs |
| dc.description.abstract-translated | As the title implies, this diploma thesis discusses the protection of property in the context of the jurisprudence of the Constitutional Court of the Czech Republic and the European Court of Human Rights. The entire content of the thesis is divided into four chapters. The first chapter defines the concept of property protection and its legal anchoring both at the national and international level. The second chapter deals with the Constitutional Court of the Czech Republic as such, the proceedings before the Constitutional Court and subsequently the jurisprudence regarding the protection of property. The third chapter is devoted to the European Court of Human Rights, the proceedings before the European Court of Human Rights and then the jurisprudence regarding the protection of property from the point of view of the European Court of Human Rights. The fourth, last chapter contains comparative views of both the above-mentioned human rights institutions on the concept of property protection. The aim of this work is to focus on the decisions of the Constitutional Court of the Czech Republic and the ECtHR in judicial practice. The secondary goal is to describe the protection of property in legal regulations and compare the approach to this topic of the two courts. | en |
