Akademické insignie a akademické obřady Západočeské univerzity v Plzni v jejích vnitřních předpisech

Abstract

Cílem tohoto článku je podrobně představit vývoj právní úpravy akademických insignií a akademických obřadů vysokých škol od roku 1989 do současnosti a konkrétně pak představení symboliky a obřadů Západočeské univerzity v Plzni, jak ji vymezují její vnitřní předpisy, neboť v takové šíři se touto problematikou ještě nikdo nezabýval a v takovém rozsahu ji nepředstavil. Právo používat akademické insignie a konat akademické obřady je zaručeno zákonem o vysokých školách. Jde přitom o zdůraznění povahy veřejné vysoké školy jako samosprávné instituce zřízené zákonem, do jejíž činnosti mohou státní orgány zasahovat jen na základě zákona a způsobem zákonem stanoveným. Akademické insignie a akademické obřady jsou pak vnějším vyjádřením uvedené nezávislosti vysokých škol na státu, což je princip, na kterém je postaveno vysoké školství v České republice po roce 1989. Již první porevoluční zákon o vysokých školách je takto koncipován a zákon z roku 1998 uvedené zásady potvrzuje a prohlubuje, když požaduje výslovně, aby problematika insignií a obřadů byla upravena ve statutu vysoké školy. Na rozboru vnitřních předpisů se ukazuje, o jaké symboly a obřady se na Západočeské univerzitě v Plzni jedná, a to z pohledu samotné univerzity i jejích fakult, které jsou též samosprávné a používají vlastní akademické insignie a konají akademické obřady podle svých zvyklostí a tradic. Konečně se příspěvek věnuje i nástinu budoucího právního vývoje, neboť v současné době probíhá novelizace vnitřní legislativy věnující se popisované problematice.The aim of this paper is to introduce the legislation of academic insignia and academic ceremonies of the Czech universities from the year 1989 up to the present in detail. Namely to introduce the symbolism and the ceremonies of the University of West Bohemia and the way of its definition in the university’s internal regulations. For nobody has ever addressed this issue in such a scope and it has not been introduced in such a range. The law to use the academic insignia and carry out the academic ceremonies is given by the Act on Higher Education. It means emphasizing the character of a state university as a self-governing institution established by law. The state authorities can intervene in the university’s activities only based on the law and in the way given by the law. The academic insignia and the academic ceremonies are then the external expression of given independence of Czech universities on the state. This is the foundation principle of the higher education in the Czech Republic after the year 1989. The first post-revolutionary act on higher education is already set up in this sense and the act from the year 1998 just confirms and expands these principles when it explicitly requires to define the issue of the insignia and the ceremonies in the university status. The analysis of the internal university regulations shows the symbols and ceremonies at the University of West Bohemia from the point of view of the university and also of its faculties. The faculties are also self-governing and they use their own academic insignia and carry out the academic ceremonies according to their customs and traditions. Finally, the paper pays attention to the outline of the future legislation development because the revision of the internal legislation devoted to the described area is currently carried out.
