dc.description.abstractZáměrem této práce je komplexně seznámit čtenáře s problematikou trestu smrti v období mezi lety 1945 až 1990, respektive od přijetí retribučního Dekretu prezidenta republiky č. 16/1945 Sb. v červnu roku 1945 až do nahrazení trestu smrti odnětím svobody na doživotí na základě zákona č. 175/1990 Sb. Důraz je kladen na vývoj právní úpravy absolutního trestu v souvislosti s potrestáním nacistických zločinců a zrádců po druhé světové válce, nástupem a utužováním komunistického režimu a následným zrušením trestu smrti. Práce je rovněž zaměřena na její následky, zejména na zneužívání absolutního trestání při politických procesech na konci čtyřicátých a začátku padesátých let včetně zmínění nejznámějších, ale i méně známých popravených osobností. Kromě právních předpisů je také samozřejmostí využití příslušných důvodových zpráv a výjimečně též judikatury.cs
dc.description.abstract-translatedThe purpose of this thesis is to comprehensively introduce the reader to the issue of the death penalty in the period between 1945 and 1990, i.e. from the adoption of the retributive Presidential Decree No. 16/1945 Coll. in June 1945 until the death penalty was replaced by life imprisonment on the basis of Act No. 175/1990 Coll. Emphasis is placed on the development of the legal regulation of capital punishment in connection with the punishment of Nazi criminals and traitors after the Second World War, the advent and strengthening of the communist regime and the subsequent abolition of the death penalty. The thesis is also focused on its consequences, especially on the abuse of capital punishment in political trials at the end of the forties and the beginning of the fifties, including the mention of the most well-known, but also less well-known executed personalities. In addition to legal regulations, it is also a matter of course to use relevant explanatory reports and, rarely, case law.en
