Drogové trestné činy ve světle aktuální novely trestního zákoníku

Abstract

Článek se zaměřuje na analýzu změn v právní úpravě drogových trestných činů v návaznosti na novelu trestního zákoníku účinnou od roku 2026. Autor se věnuje zejména hmotněprávním aspektům novely, jejím legislativním východiskům a předpokládaným dopadům na aplikační praxi. Pozornost je soustředěna na identifikaci klíčových změn, problematických oblastí a interpretačních otázek, které novela přináší, včetně posunu v přístupu k postihu drogové kriminality a částečné dekriminalizace konopí.

The article analyses changes in the legal regulation of drug-related criminal offences following the amendment to the Criminal Code effective from 2026. The author focuses primarily on the substantive law aspects of the amendment, its legislative background, and its anticipated impact on legal practice. Particular attention is paid to the identification of key changes, problematic areas, and interpretative challenges arising from the amendment, including a shift in the approach to the prosecution of drug-related crime and the partial decriminalisation of cannabis.
