dc.description.abstractPráce se zabývá střetem dvou důležitých právních institutů práva soukromého, kterými jsou insolvenční řízení a společné jmění manželů. To znamená, že v práci je definováno insolvenční řízení a jsou důkladně probrány způsoby řešeny úpadku. Dále je probráno společné jmění manželů, a to vč. režimů společného jmění manželů a způsobů vypořádání společného jmění manželů. Ve zbylých částech práce jsou rozebrána specifika, která vznikají spojením institutů, tj. především konkurs ve společném jmění manželů a oddlužení ve společném jmění manželů.cs
dc.description.abstract-translatedThe thesis deals with the conflict between two important legal institutes of private law, which are insolvency proceedings and marital community property. This means that in the work, insolvency proceedings are defined and the approaches to resolving debtor insolvency are thoroughly discussed. Furthermore, marital community of property is examined, including the regimes of marital community property and the methods of settling the assets between the spouses. In the remaining parts of the work, the specifics arising from the combination of these legal institutes are analyzed, with the focus primarily on bankruptcy in marital community of property and debt relief in marital community of property.en
