| dc.description.abstract | Svou práci jsem zaměřil na zpracování hmotněprávní otázky týkající se trestných činů nacházejících se ve zvláštní části trestního zákoníku v Hlavě I., dílu prvém, tj. Trestné činu proti životu se zaměřením na trestný čin vraždy a jeho aspekty, přičemž jsem využil možnosti historického náhledu na vývoj trestního práva v této otázce s tím, že jsem využil svých zkušeností, kdy jsem pracoval u Krajského soudu v Ústí nad Labem, trestní oddělení, I. hlava. Využil jsem možnosti zapracování vědní disciplíny behaviorální analýzy v souvislosti s typováním pachatelů trestného činu vraždy. A v neposlední řadě kratičký exkurz do práva Anglosaského. | cs |
| dc.description.abstract-translated | The thesis is divided into four main chapters: historical development, legal description, behavioral analysis and a short excursion into the Anglo-Saxon legal system. Them main focus of the thesis i substantive and procedural law in relation to murder. It begins with Kristian z Koldína, who was the very first author of the legal code ?The Law of the Bohemian Kingdom.? This code had been applied until 1786. The next period is the time between and after the World Wars. The time after World War II concerns the protection of socialist property. Life, health and similar values were secondary. A change has come through the new Criminal Code number 40/2009 Sb., in which the protection of life and health are a priority. The next chapter describes how [behavioral analysis is helpful in the discovery of an offender or a murderer.] This tool in the hands of the Police shows us how to properly discover who is responsible for the crime. The Police are not successful every time, even though their job may be done very well. Anglo-Saxon law is different from Continental law because it uses customary law, judicial precedents and legal literature. The thesis brings the reader closer to these differences. | en |
