dc.description.abstractDiplomová práce se věnuje problematice ochranných známek v mezinárodním obchodu. V práci je popsána historie ochranných známek, jejich funkce a obecné vlastnosti. Následně práce systematicky pojednává o právní úpravě ochrany práv k ochranným známkám v mezinárodním a evropském měřítku, které analyzuje a dále srovnává relevantní ustanovení s konkrétní národní právní úpravou. Na mezinárodní úrovni byla hlavní pozornost věnována Dohodě TRIPS, na komunitární úrovni zejména Směrnici Rady č. 2008/95/ES, Nařízení Rady č. 207/2009, Směrnici Evropského parlamentu č. 2004/48/ES a aktuálnímu návrhu revize Směrnice č. 2004/48/ES.cs
dc.description.abstract-translatedThe diploma thesis discuss the issue of trademarks in the international trade. It describes the history of trade marks, their functions and general properties. Subsequently the work systematically discusses the legislation protecting trademark rights in international and European level, which analyzes and compares the relevant parts with specific national legislation. At the international level, the main attention was focused to the TRIPS Agreement and at the community level to the particular Directive 2008/95/EC, Council Regulation No 207/2009, Directive 2004/48/EC and the current proposal revise Directive No 2004/48/ES.en
