dc.description.abstract-translatedThis article provides a brief overview of the main historical milestones of the institute of nullity in the conditions of the Slovak Republic. The article is divided into 4 chapters. The first chapter is devoted to the period of the Austro-Hungarian Monarchy, during which the foundations of public administration were laid. The competences of the authorities were established by regulations. In this period the nullity statute was not defined, there was no coherent law for administrative law. The second chapter is devoted to the period after 1918, when the first Czechoslovak Republic was established, as well as the first Supreme Administrative Court, which was empowered to examine the legality of the procedure of administrative authorities as well as of the administrative acts issued by those authorities. The third chapter is devoted to the period of Czechoslovakia under socialism. During this period, the basic principles of democracy were denied and, consequently, the institute of nullity was in the background, as the state was governed by a narrow group of people who had a monopoly of state power. The fourth chapter deals with the post-1989 period, after the change of the state regime. Here we are already in the present, when the institution of nullity started to take on its present content. In the conditions of the currently valid legal order of the Slovak Republic, nullity is not defined. Its content is formed only by legal theory and court decisions. In the Czech Republic, much more attention is paid to this institute, as its definition, grounds and the procedure of the authorities in its occurrence are contained in Act No. 500/2004 Coll. on Administrative Procedure.en
