| dc.description.abstract-translated | The constitutional system of the Slovak Republic determines the limits of permissible interference in political rights in two ways. In a standard state of security, the Constitution of the Slovak Republic limits political rights. During emergency situations, a special legal regime applies, where the broadest per missible scope of restrictions on political rights is defined by the Constitutional Law on Security. The Constitutional Security Act is lex specialis to the Consti tution, which means that the regulation contained therein takes precedence in application and interpretation over the Constitution for the duration of the declared (declared) state of emergency. During states of emergency, only those political rights can be restricted and only to the extent that the constitutional law refers to. Meanwhile, the limits on interference with political rights formulated in the Constitutional Security Act may be considered too vague. At the international level, according to the Venice Commission, there are three key ways of dealing with emergencies. These are exceptions, limitations and derogations from human rights. The rules for the application of human rights derogations under both Article 15 of the Convention and Article 4 of the Covenant are largely identical. | en |
