dc.description.abstractTato diplomová práce se zabývá problematikou náhradního mateřství v kontextu ochrany lidských práv. Cílem práce je analyzovat právní a etické aspekty této praxe a posoudit její slučitelnost s mezinárodními standardy ochrany základních práv všech zúčastněných osob, zamýšlených rodičů, náhradních matek a narozených dětí. Práce vychází z univerzálních a regionálních lidskoprávních dokumentů, judikatury Evropského soudu pro lidská práva a odborných pramenů z oblasti bioetiky, mezinárodního i rodinného práva. Pozornost je věnována rovněž fenoménu reprodukční turistiky, komercializaci lidského těla a otázce, zda komerční náhradní mateřství může představovat formu obchodu s dětmi. V závěru práce jsou formulována doporučení de lege ferenda a úvahy nad potřebou mezinárodní právní harmonizace.cs
dc.description.abstract-translatedThis thesis explores the issue of surrogacy in the context of human rights protection. The main objective is to analyze the legal and ethical aspects of surrogacy and to assess its compatibility with international standards for the protection of fundamental rights of all parties involved - intended parents, surrogate mothers, and children born through surrogacy. The research is based on universal and regional human rights instruments, case law of the European Court of Human Rights, and academic sources from the fields of bioethics, international law, and family law. Particular attention is paid to the phenomenon of reproductive tourism, the commercialization of the human body, and the question of whether commercial surrogacy may constitute a form of child trafficking. The final part of the thesis presents de lege ferenda recommendations and reflects on the need for international legal harmonization.en
