dc.description.abstract-translatedIn the paper presented, the author points to the institution of donation used in society and the related right of the donor to demand the return of the donation according to the provisions of § 630 of the Civil Code as amended. The strict wording of this provision with broadly conceived terminology causes a diverse interpretation in application practice from the perspective of jurisprudence, which may subsequently reduce legal certainty in its application. The author sees in the legal regulation de lege lata a starting point in pointing out the presented considerations of de lege ferenda.en
