dc.description.abstractDiplomová práce se zabývá soudní exekucí z hlediska zřízení exekutorského zástavního práva na nemovitosti a prodejem nemovitosti. Úvod práce obecně pojednává o pojmech soudní exekuce, soudní exekutor a exekuční řízení. Pro samotný postih nemovitostí je důležitá orientace v zákonech zakotvujících zápisy listin vyhotovených soudním exekutorem do katastru nemovitostí o čemž pojednává další kapitola diplomové práce. Následující kapitoly detailně probírají postihování nemovitostí zřízením exekutorského zástavního práva a průběh prodeje nemovitosti v dražebním jednání. Závěr práce je věnován srovnání s právní úpravou Slovenské republiky a úvaze o tom, kam směřuje právní úprava soudních exekucí do budoucna.cs
dc.description.abstract-translatedThis diploma thesis deals with judicial distrain from the point of view of the establishment of the lien law on properties. The introduction of the thesis generally concentrates on the key concepts of judicial distrain, judicial distrainor and the process of distraining. For the recource of properties a good orientation in the Register of Properties of the Czech Republic is essential, particularly from the point of view of records engrossed within judicial distrain. Thus, the next chapter of the diploma thesis deals with this topic. The follow-up chapter concentrate in detail on the recourse of properties by lien and the process of the sale of properties in a sale action. The last part of the thesis compares the legislation of the Slovak Republic and it also deals with the future direction of judicial distrain.en
