dc.description.abstract-translatedThis article addresses the crucial question of balancing freedom of expression with criminal repression in a democratic society, specifically in the context of the First Czechoslovak Republic. It analyzes how the Supreme Court of Czechoslovakia interpreted the provisions of Act No. 50/1923 Coll. for the Protection of the Republic during the interwar period. The aim is to examine the extent to which the court took into account the subjective element of the criminal offense and the principles of humanity, ultima ratio, and the protection of the democratic rule of law when applying this law. The article also tests hypotheses about whether the Supreme Court prioritized the protection of the state over the individual rights of citizens and whether its decision-making during the validity of this law was compatible with the fundamental principles of a democratic legal state in the context of the period’s social and political tensions.en
