dc.description.abstractDiplomová práce se soustředí na právo rozšiřování Evropské unie. Práce se skládá ze dvou částí. V první je představen teoretický základ práva rozšiřování, který je poté v následující části utilizován na případ Turecka. Ve vztazích mezi Tureckem a EU se projevuje dichotomie vztahů. Zaprvé: práva a povinnosti vážící se k celní unii mezi Tureckem a EU. V tomto contextu autor zkoumá efektivitu institucionální struktury a procesních mechanismů. Zadruhé: práva a povinnosti vznikající v souvislosti s předvstupním procesem. U těchto se autor zaměřil na okolnosti a důsledky principu kondicionality.cs
dc.description.abstract-translatedGraduate paper deals with the topic of enlargement of the European Union as one of the most successful external policies of the EU until the date. The paper consists of two relatively independent but indivisible parts. In the first part, the author gives a theoretical framework of accession process. Theoretical principles are subsequently applied in a case study on the very specific legal relation of Turkey and the European Union. The first part itself is divided into two chapters. In the first one, author presents the dynamics in development of enlargement law in the primary EU law, namely Treaties. In the second chapter, the abstract norms of enlargement law are extracted from the extensive amount of regulations created by the EU bodies over the time of past enlargements and are presented in a coherent, systematically-structured way into the chapters according to the substantial or procedural aspects of those norms. Turkey-EU pre-accession period relations can be seen as two formally independent layers of legal relations which have further consequences. Firstly, EU-Turkey customs union with rights and obligations arisen out of it. Within this context author examines the institutional set-up and procedural mechanisms of customs union and its effectiveness in time of changing circumstances. And secondly, rights and obligations which have arisen out of process governed by enlargement law. The process of enlargement is dominated by principle of conditionality and author focuses on its usage in the EU-Turkey enlargement relations. The goal is to present review of successful application of mentioned principle with its positive impact on domestic law system as well as its potential failure if not applied properly.en
