dc.description.abstractBakalářská práce na téma Manželství stejnopohlavních páru pohledem ústavního práva se zabývá analýzou institutu manželství a registrovaného partnerství v podústavní a ústavní rovině. Práce je rozdělena do tří kapitol. V první kapitole je rozebrán ústavní vývoj institutu manželství a legislativní vývoj registrovaného partnerství, pohled pramenů práva Evropské unie, mezinárodních smluv, Ústavy, Listina základních práv a svobod a významných rozsudků Evropského soudu pro lidská práva. Dále se kapitola věnuje úpravě manželství v občanském zákoníku a úpravě registrovaného partnerství. V druhé kapitole je porovnána popularita obou institutů, jednotlivé rozdíly v právních úpravách obou institutů a pohled Ústavního soudu ČR na srovnání dvou sobě podobných institutů. Ve třetí kapitole jsou rozebrány postoje ústavních soudů zemí Evropy a aktuální vývoj zrovnoprávnění manželství pro všechny.cs
dc.description.abstract-translatedThis thesis called ,,Same-Sex Marriage from the Perspective of Constitutional Law" deals with the analysis of the institution of marriage and registered partnership at the sub-constitutional and constitutional levels. The thesis is divided into three chapters. The first chapter examines the constitutional development of the institution of marriage and the legislative development of registered partnership, considering the perspectives of sources of law such as the European Union, international treaties, the Constitution, the Charter of Fundamental Rights and Freedoms, and significant judgments of the European Court of Human Rights. Furthermore, the chapter focuses on the regulation of marriage in the Civil Code and the regulation of registered partnership. In the second chapter, the popularity of both institutions is compared, along with the individual differences in the legal regulations of both institutions, and the perspective of the Constitutional Court of the Czech Republic on the comparison of two similar institutions. The third chapter analyzes the stances of constitutional courts in European countries and the current progress towards marriage equality for all.en
