| dc.description.abstract-translated | The article “Surveillance Behind Bars” focuses on the legal issues surrounding the monitoring and recording of telephone conversations of incarcerated individuals in the Czech Republic. While this tool is essential for maintaining prison security and preventing criminal activities, it raises concerns about the protection of fundamental rights, particularly the right to privacy and confidential communication. The article analyzes the legal framework governing prison surveillance, its constitutional and international limitations, and examines the admissibility of these recordings as evidence in criminal proceedings. The article outlines the main legal provisions regulating prison surveillance, including Act No. 169/1999 Coll., on the Execution of Imprisonment, and Act No. 293/1993 Coll., on the Execution of Custody. It also discusses case law from Czech courts and the European Court of Human Rights, emphasizing the necessity of proportionality and adequacy in the infringement of the rights of incarcerated individuals. Particular attention was paid to recent case law from higher courts, which have permitted the use of prison recordings as evidence in criminal proceedings. In this context, the article highlights several shortcomings in this case law and the potential challenges associated with its application. | en |
