dc.description.abstractDiplomová práce je zaměřena na vznik a zánik manželství v ČSR do roku 1945, a to zejména s ohledem na historický vývoj manželského, respektive rodinného práva. Úvodní kapitoly práce jsou věnovány značnému vlivu římského práva, které bylo recipováno zejména prostřednictvím práva kanonického. Kanonickému právu je věnována samostatná kapitola, ve které je blíže popsán vznik a zánik manželství v době, kdy byla problematika manželství zcela v rukou křesťanské církve. Následující kapitoly se věnují dalším obdobím, která byla pro podobu vzniku a zániku manželství významná. Jedná se zejména o období vlády Marie Terezie a Josefa II. Stěžejní kapitola této práce se zaměřuje na vznik a zánik manželství po vzniku samostatné Československé republiky.cs
dc.description.abstract-translatedThe diploma thesis is focused on the origin and demise of marriage in the Czechoslovak Republic until 1945, especially with regard to the historical development of matrimonial and family law. The opening chapters of the work are devoted to the significant influence of Roman law, which was received mainly through canon law. A separate chapter is dedicated to canon law, in which the origin and demise of marriage are described in more detail at a time when the issue of marriage was completely in the hands of the Christian Church. The following chapters are dedicated to other periods that were significant for the form of the origin and demise of marriage. This is mainly the period of the reigns of Maria Theresa and Joseph II. The core chapter of this work focuses on the creation and dissolution of marriage after the creation of the independent Czechoslovak Republic.en
