dc.description.abstract-translatedThe article explores the evolution of the international legal subjectivity of individuals, departing from the traditional focus on states as main subjects of international law. In recent years, however, increased attention has been paid to the recognition of certain rights and obligations of individuals within the international legal framework, primarily, but not exclusively, through the international legal regulation of the protection of human rights and fundamental freedoms. The internationalization of human rights, notably marked by the 1948 Universal Declaration of Human Rights, has played a pivotal role in reshaping the legal status of individuals. Despite not being legally binding, the Universal Declaration significantly influenced subsequent agreements such as the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights. Delving into the specialized area of asylum and refugee status, the article emphasizes the intricate balance between individual rights and state obligations. Despite the interchangeable use of the terms “asylum” and “refugee status” due to their shared humanitarian purpose, the article elucidates several differences between them. These distinctions, underscore the complex interplay between international law, state sovereignty, and the imperative to protect those facing persecution. The legal definitions and nuances discussed in the article contribute to a comprehensive understanding of the global landscape surrounding asylees and refugees as a subjects of international law.en
