dc.description.abstract-translatedThe article is focused on the recent case law of the Supreme Administrative Court in the area of aggressive tax planning and abuse of law. The author has purposefully chosen to examine decisions which are focused on areas other than the abuse of law in the area of value added tax (abuse of law when claiming the right to tax deduction) and the author contemplates whether the case law in the area of direct taxes differs. The purpose of this article is to analyse the term of aggressive tax planning and abuse of law in relation to recent case law of the Supreme Administrative Court.en
