dc.description.abstract-translatedThe article explores the phenomenon of privatization in the criminal justice process, particularly focusing on the process of evidentiary procedure in pre-trial proceedings. It highlights a global trend towards the incorporation of private law elements into traditionally public domains, including criminal procedural law. This shift results in the increased participation of private entities in the evidence-gathering process. This involvement of private bodies, while potentially enhancing efficiency and addressing resource limitations in the justice system, introduces several risks: Ensuring the legality and admissibility of privately obtained evidence; Maintaining equality of parties in criminal proceedings; Preserving the integrity of the criminal process. The article underscores the necessity for normative safeguards to mitigate risks like manipulation, subjectivity, and inequality while maintaining fairness, legality, and the rule of law. It calls for careful oversight by public authorities (e.g., law enforcement and courts) to ensure private actors‘ contributions align with legal frameworks and procedural principles.en
