| dc.description.abstract-translated | The power of the President of the Slovak Republic under the provision of Article 102 (1) is one of the powers with the most significant implications in terms of the practical functioning of the state in the whole society. The decision of the President of the Slovak Republic to refuse to nominate a person proposed or intended to be proposed as a candidate for nomination as a member of the Government of the Slovak Republic is inevitably linked to the debate among the proponents and opponents of the possibility of presidential discretion in the nominations submitted to the President. Taking into account the relevant doctrine and case law, however, it can be concluded that the theory of verbal sight in interpreting the various powers of the constitutional bodies finds no logical support in the constitutional text. Relying on the interpretative reso lution of the Constitutional Court of the Slovak Republic in the proceedings under Case No I. ÚS 39/93, it can be stated that the President of the Slovak Republic, after submitting specific nominations for appointment as members of the Government of the Slovak Republic, is obliged to consider and deal with these submitted proposals, but he is not obliged to comply with the proposal of the Prime Minister of the Slovak Republic. Therefore, for the reasons stated above, it can be concluded that despite the largely representative powers of the President of the Slovak Republic, the power to appoint members of the Government of the Slovak Republic under the provisions of Article 102(1) of the Constitution of the Slovak Republic is a power with the possibility of involving his own discretion, without any obligation to uncritically accept the proposal of the Prime Minister of the Slovak Republic. | en |
