dc.description.abstractdozoru vykonávaného nad provozováním hazardních her přinesl zákon č. 186/2016 Sb., o hazardních hrách, ve znění pozdějších předpisů (dále jako ?herní zákon?). První tři kapitoly rigorózní práce jsou kapitolami obecnými, kdy tyto přibližují oblast správního dozoru a provozování hazardních her v obecné rovině, jakožto i vymezují právní úpravu správni?ho dozoru vykonávaného nad provozováni?m hazardni?ch her. Čtvrtá kapitola, která představuje stěžejní část rigorózní práce, již detailně přibližuje změny, které do jednotlivých prvků správního dozoru vykonávaného nad provozováním hazardních her vnesl herní zákon. Tato je dále rozčleněna na dvě podkapitoly, kdy první z těchto je zaměřena na změny jednotlivých prvků první fáze správního dozoru, jako je např. vymezení předmětu správního dozoru, jednotlivých dozorčích orgánů či subjektů, vůči kterým je správní dozor vykonáván, jakožto i práv (oprávnění) a povinností dozorčích orgánů. Druhá podkapitola je pak zaměřena na změny, které herní zákon přinesl v jednotlivých prvcích druhé fáze správního dozoru, jimiž jsou kromě vymezení jednotlivých dozorčích orgánů či subjektů, jenž mohou být subjektem přestupku, např. i nápravná opatření či správní tresty. Samotný závěr čtvrté kapitoly pak obsahuje úvahy de lege ferenda, které by mohly správní dozor vykonávaný nad provozováním hazardních her ještě více zefektivnit.cs
dc.description.abstract-translatedThe thesis deals with the changes introduced by gaming law no. 186/2016 Coll., on gambling games, as amended (hereinafter referred to as the "gambling law"), to the individual elements of both phases of administrative supervision over the operation of gambling. The first three chapters of the thesis are general in nature and introduce the area of administrative supervision and the operation of gambling in a general sense, as well as define the legal regulation of administrative supervision over the operation of gambling. The fourth chapter, which represents the core part of the thesis, presents in detail the changes introduced by the gambling law to the individual elements of administrative supervision over the operation of gambling. This chapter is further divided into two subsections. The first of these focuses on the changes in the elements of the first phase of administrative supervision, such as the definition of the subject of administrative supervision, the supervisory authorities or entities over whom the supervision is conducted, as well as the rights (authorizations) and duties of the supervisory authorities. The second subsection then focuses on the changes introduced by the gambling law in the elements of the second phase of administrative supervision, which, in addition to defining the supervisory authorities or entities that may be subject to an offense, also includes corrective measures and administrative penalties. The conclusion of the fourth chapter contains de lege ferenda considerations that could further enhance the effectiveness of administrative supervision over the operation of gambling.en
