dc.description.abstract-translatedA legal act is a legal fact dependent on the human will (subjective legal fact), which follows the law, and its basis is a legally recognised private will of a subject. In the system of legal facts, legal acts have a special place, which distinguishes them from unlawful acts, constitutive judicial or other official decisions, but also from creation of a work or thing. The conceptual features of a legal act are the expression of the will, the intention to create, modify or extinguish rights and duties, and recognition by the legal order. However, the determination of the nature of a legal fact is not an analysis of a factual situation, but an interpretation of a legal provision. The question is therefore whether the legal provision requires an expression of the will with the quality of a legal act.en
