dc.description.abstract-translatedThis article deals with the consequences of a breach of the obligation of a consumer credit provider under Section 86 of the Consumer Credit Act to verify the creditworthiness of the credit applicant, with an emphasis on the procedural consequences of a finding of a breach of this obligation in civil court proceedings. With reference to recent case law, this article highlights the highly problematic interpretation of the consequences of a failure to check the creditworthiness of a consumer for the credit provider, but also for the judicial system and the principle of the right to judicial protection.en
