| dc.description.abstract | Příspěvek se zabývá kolektivním vymáháním práva a hromadnými žalobami v rakouském právním pro středí. Nezohledňuje ještě recentní (a opožděnou) implementaci směrnice EU 2020/1828 o zástupných žalobách na ochranu kolektivních zájmů spotřebitelů, neboť k ní došlo až v posledních týdnech. Zabývá se proto zejména žaloba mi podle rakouského Zákona o ochraně spotřebitele (KSchG) a podle Zákona proti nekalé soutěži (UWG), především žalobami na zdržení se (protiprávního) jednání; představuje také model (spíše judikatorní než legislativní), kterým lze v rakouském právním prostředí hromadné nároky uplatňovat již dnes. | cs |

It does not yet take into account the recent (and delayed) implementation of EU Directive 2020/1828 on representative actions for the protection of consumers‘ collective interests, as this has only occurred in recent weeks. Therefore, it deals mainly with actions under the Austrian Consumer Protection Act (KSchG) and the Unfair Competition Act (UWG), especially actions for injunctive relief; it also presents a model (more jurisprudential than legislative) by which rights of large masses of subjects can already be litigated in Austria today | en |
