dc.description.abstract-translatedThe paper deals with the issue of presumptions and fictions in private law. The author sees the essence of presumptions in the fact that a fact presupposed by a presumption is considered to be established, proven even without the fact having to be proved. On the contrary, according to the author, the fiction does not serve to establish a fact, but is a manifestation of legislative technique. If the legislator wishes to associate with a certain factual situation the same legal consequences that are defined in detail for another factual situation, instead of repeating them, he can simply say that the factual situation in question is to be regarded as a different factual situation. The author goes on to discuss the division of presumptions. According to various criteria, he divides them into pre sumptions of substance and form, presumptions of law and fact, presumptions of law and presumptions of fact, and rebuttable and irrebuttable presumptions. The author also presents a scheme of construction of presumptions.en
