dc.description.abstractPředkládaná rigorózní práce se v širších souvislostech zabývá trestným činem znásilnění, přičemž stěžejní pozornost věnuje jeho redefinici účinné od 1. ledna 2025. Od historickoprávního exkurzu sledujícího vývoj pojetí tohoto deliktu na území českých zemí, přes podrobný rozbor skutkové podstaty trestného činu znásilnění před redefinicí a její výklad v judikatuře Nejvyššího a Ústavního soudu, se práce postupně obrací k teoretickým modelům vymezení znásilnění a jejich komparaci s úpravami vybraných evropských států. Významnou a současně stěžejní část tvoří analýza nové skutkové podstaty znásilnění a vyčlenění trestného činu sexuálního útoku, zasazená do kontextu mezinárodních lidskoprávních standardů. Nedílnou součástí je i vlastní empirický výzkum zahrnující analýzu 145 soudních rozhodnutí. Cílem práce je nejen zhodnotit přínosy redefinice trestného činu znásilnění, ale též identifikovat dosavadní aplikační problémy a formulovat návrhy de lege ferenda směřující k posílení ochrany sexuální autonomie obětí.cs
dc.description.abstract-translatedThis rigorous thesis deals with the crime of rape in a broader context, focusing on its redefinition effective from January 1, 2025. From a historical and legal overview tracing the development of the concept of this offense in the Czech lands, through a detailed analysis of the constituent elements of the crime of rape prior to its redefinition and its interpretation in the case law of the Supreme Court and the Constitutional Court, the thesis gradually turns to theoretical models of defining rape and their comparison with the regulations of selected European countries. An important and central part of the thesis is the analysis of the new constituent elements of the crime of rape and the separation of the crime of sexual assault, set in the context of international human rights standards. An integral part of the thesis is empirical research involving the analysis of 145 court decisions. The aim of the thesis is not only to evaluate the benefits of redefining the crime of rape, but also to identify existing problems in its application and to formulate proposals de lege ferenda aimed at strengthening the protection of the sexual autonomy of victims.en
