Majetková exekuce a beneficium competentiae v římském právu. Inspirace pro moderní dobu?

Abstract

Článek se zabývá problematikou majetkové exekuce v římském právu a hledá inspiraci pro moderní dobu. Autor podrobně popisuje vývoj právní úpravy výkonu soudního rozhodnutí v římském právu. Zabývá se také jednotlivými historickými etapami tohoto vývoje. Podrobněji se zaměřuje na majetkovou ochranu povinného, tak jak se vyvinula ještě v klasickém římském právu. Povinný sice musel odevzdat věřitelům celý svůj majetek, který byl prodán (jako celek) a z výtěžku byly uspokojeni věřitelé. Zároveň však mohl požádat o beneficím comptetentiae, které pro něj umožnilo zachovat existenční minimum.

The article deals with the issue of property execution in Roman law and seeks inspiration for modern times. The author describes in detail the development of the legal regulation of the enforcement of judgments in Roman law. He also discusses the various historical stages of this development. He focuses in detail on the protection of the debtor's property as it developed in classical Roman law. The debtor had to surrender all his property to his creditors, which was sold (as a whole) and the creditors were satisfied from the proceeds. At the same time, however, he could apply for beneficium comptetentiae, which allowed him to maintain a subsistence minimum.
