| dc.description.abstract | Předložená práce ?Incidenční spory? je zaměřena na incidenční spory, jejich druhy a řízení o nich. Incidenční spor je soudní spor projednávaný v rámci insolvenčního řízení u insolvenčního soudu, který se zahajuje na návrh a má povahu žaloby. Část práce je tedy zaměřena na zahájení a průběhu řízení u soudu. V praktické části byla vyhodnocena statistická data o době trvání insolvenčního řízení, počtu incidenčních návrhů a době trvání incidenčních sporů. Cílem práce je definovat pojem incidenční spor a vymezit jednotlivé druhy pojmenované v zákoně, i ty které zákon nepojmenovává, ale za incidenční je označuje v dalších částech zákona. | cs |
| dc.description.abstract-translated | The presented thesis ?Incidental Disputes? is focused on incidental disputes, their types and proceedings involving them. The incidental dispute litigation is discussed in insolvency proceedings with the court, which is initiated at the petition and has the nature of an indictment. This part of the thesis is focused on the initiation and course of proceedings in the court. In the practical part was evaluated by statistical data on the duration of the insolvency proceedings, on the number of proposals of incidence and duration of incidental disputes. The aim of the thesis is to define the notion of incidental dispute and define individual types stated in the law, and those which the law does not name, but recognizes them as incidental disputes in other parts of the Act. | en |
