| dc.description.abstract | Tato práce se zabývá důkladným zkoumáním konsorciální smlouvy v jejím historickém a současném kontextu, poukázáním na klady a zápory jejího využití v obchodních vztazích a konečně zamyšlením nad tím, zda je konsorcium v současném pojetí typem občanskoprávní společnosti nebo innominátním kontraktem. Pozornost je věnována odlišení konsorcia od souvisejících právních institutů. Práce se rovněž zabývá klíčovými pravidly a principy tohoto institutu, včetně rozhodovací praxe soudů v kontextu platné právní úpravy. Závěrečná část je věnována syntéze závěrů práce s přihlédnutím k zahraniční právní úpravě. | cs |
| dc.description.abstract-translated | This thesis deals with a thorough examination of the consortium contract in its historical and contemporary context, at highlighting the pros and cons of its use in commercial relations, and finally at reflecting on whether the consortium in the current concept is a type of civil law partnership or an innominate contract. Considerable attention is paid to the differentiation of consortium from related legal institutes. The thesis also discusses the key rules and principles of the institute, including the decisional practice of the courts in the context of the current legislation. The final part is devoted to the synthesis of the thesis conclusions taking into account foreign legislation. | en |
