dc.description.abstract-translatedFollowing paper deals with recent judgment of the Court of Justice of European Union known as Perle. For the first time CJEU has confirmed that prohibition of abuse of law has its place in migration law as well. The Perle judgment suggests that Member States exercise their right to control migration with a reference to general principle of prohibition of abuse of law. This may, however, be conflict with important constitutional principle such as a principle of legality which requires that state may act only if the law (precisely a statute) allows him to do so. The author argues that authorities can terminate alien’s residence due to his previous abusive practices even if there is no support in the letter of the law. It seems that the right to withdraw one’s right to stay is justifiable in the context of residence permits governed by EU law thanks to cornerstones of Union law: the supremacy and direct effectiveness of EU law.en
