"Kupčení s hlasy" ve volbách z pohledu trestního práva

Abstract

Zaměření samotného pojednání je popis předešlé a současné právní úpravy skutkové podstaty „maření přípravy a průběhu voleb a referenda“. Popis bude nejen na možnosti ovlivnění voleb, zejména voleb do zastupitelstva obcí, ale i popis kvalifikace skutku (zejména jednání), které naplňuje uvedenou skutkovou podstatu. Bude se jednat o základní popis pojetí zejména voleb do zastupitelstev obcí, možnosti ovlivnění, protiprávní jednání a v neposlední řadě legislativní proces změny trestního zákoníku. Dále půjde o systematický popis oblasti „nakupování, kupčení“ hlasů, v návaznosti na trestněprávní nauku v proměnách vývoje právní úpravy.

The focus of this paper is the description of the previous and current legal regulation of the criminal offense of “obstructing the preparation and conduct of elections and referenda.” The description will not only address the possibilities of influencing elections, particularly municipal council elections, but also the classification of the offense (especially conduct) that fulfills the elements of this crime. It will provide a basic outline of the concept of municipal elections in particular, the possibilities of influence, unlawful conduct, and, last but not least, the legislative process of amending the Criminal Code. Furthermore, it will offer a systematic description of the issue of “vote buying and trading,” in connection with criminal law theory and the development of the legal framework over time.
