dc.description.abstractDiplomová práce se zabývá problematikou umělého přerušení těhotenství. Práce je rozdělena na dvě části. První část velmi obecně uvádí do etických a právních aspektů umělého přerušení těhotenství, dále seznamuje se čtyřmi typy právních úprav umělého přerušení těhotenství jednotlivých států světa se zaměření na členy Rady Evropy. Blíže seznamuje s platnou právní úpravou v České republice. Druhá část obsahuje přehled rozsáhlé judikaturní činnosti soudu v otázkách umělého přerušení těhotenství. Řeší otázky práva v oblasti sexuálního vzdělávání, podmínky vyjadřování postojů k problematice interrupce. Další kapitoly seznamují s judikaturou ve věcech počátku lidského života a odpovědnostních vztahů lékařů a dalších osob ve vztahu k těhotné ženě. Poslední kapitoly řeší příbuznou problematiku právní ochrany a postavení embrya a plodu a právní postavení otce nenarozeného dítěte. Cílem diplomové práce bylo vytvořit ucelenou publikaci mapující historii a vývoj judikaturní činnosti Evropského soudu pro lidská práva a Evropské komise pro lidská práva a ušetřit tak čtenáři studium stovek stran rozhodnutí. Na nejznámějších judikátech potom znázornit principy a prvky rozhodovací činnosti, které jsou aplikovatelné na podobné případy do budoucna. Druhotným cílem bylo zpracovat a graficky zobrazit právní úpravy jednotlivých států v otázkách umělého přerušení těhotenství a popsat vývojové trendy.cs
dc.description.abstract-translatedThe thesis deals with the legal regulation of abortion from the perspective of The European Court of Human Rights. It is divided into two parts. The first part introduces, in general, the ethical and legal aspects of artificial termination of pregnancy, and also inform about four types of legal regulation of abortion in the countries around the world with a special focus on members of the Council of Europe. It presents the valid legal regulations in the Czech Republic. The second section contains an overview of the Court's extensive case law on abortion. It deals with issues of law on the field of sexual education, conditions for expressing attitudes towards the issue of abortion. The next chapters introduce the case law in matters of the beginning of human life and the responsibility of doctors and other persons in relation to a pregnant woman. The last chapters deal with related issues of legal protection and the status of the embryo and fetus and the legal status of the unborn child's father. The aim of this thesis was to create a comprehensive publication mapping the history and development of the jurisprudence of the European Court of Human Rights and the European Commission for Human Rights, thus saving the reader from studying hundreds of pages of decisions. Then, on the best-known judgments, illustrate the principles and elements of decision-making that are applicable to similar cases in the future. The secondary objective was to elaborate and graphically show national legislation on abortion and to describe trends.en
