dc.description.abstractDiplomová práce je zaměřena na problematiku komparace soudního systému v českých zemích za vlády Josefa II. s francouzskou úpravou soudnictví v období osvícenství (zaměřenou zejména na napoleonskou éru). Z důvodu kontinuity a zohlednění historických souvislostí se práce zabývá také bližším pohledem na jednotlivé soudní systémy. První část této práce pojednává o soudním systému v českých zemích v období pobělohorském. V druhé části je popsána francouzská úprava soudnictví od období bezprostředně předcházejícímu Velké francouzské revoluci. Poslední část práce je zaměřena na samotnou komparaci, která se mj. dotýká historického, zejména politického kontextu vzniku obou soudních systémů, jejich podoby, relevantní právní úpravy a průběhu soudního řízení.cs
dc.description.abstract-translatedThe diploma thesis is focused on the issue of the comparison of the judicial system in the Czech lands under the reign of Joseph II. and French regulation of the judiciary during the period of the Enlightenment (in particular focused on Napoleonic era). The continuity of the diploma thesis and its historical context assumes closer look to the individual judicial systems. The first part of diploma thesis traces the judicial system in the Czech lands since the Battle of White Mountain. In the second part the French judiciary is followed since the period prior to the French revolution. The last part is focused on the comparison itself, which concerns historical, especially political context of origin of the judicial systems, their form, relevant legislation and the course of the court proceedings.en
