Balkony a lodžie jako předmět vlastnického práva

Abstract

Cílem příspěvku je zhodnotit stávající právní úpravu vlastnického práva k balkonům a lodžiím v bytových domech, rozdělených na bytové jednotky. Autorka se zabývá především otázkou, zda lze balkony a lodžie považovat za příslušenství jednotky, a tedy předmět výlučného vlastnického práva majitelé této jednotky, nebo se na ně vztahují příslušná zákonná ustanovení upravující společné části domu. Pozornost je zaměřena rovněž na problematiku správy a údržby balkonů a lodžií.The aim of the paper is to evaluate the current legal regulation of the ownership right to balconies and loggias in apartment buildings divided into residential units. The author deals primarily with the question whether balconies and loggias can be considered as accessories of the unit, and therefore the subject of the exclusive property right of the owner of this unit, or whether they are subject to the relevant statutory provisions governing the common parts of the building. Attention is also focused on the issue of management and maintenance of balconies and loggias.
