dc.description.abstract-translatedFew criminal cases of the past decades have resonated as strongly as the case of Robert Tempel. This case highlighted the phenomenon of judicial ping-pong in the context of the issue of appellate court instructions, their binding force and the evaluation of evidence in appellate proceedings. This paper not only introduces the case and its merits, but, using the case as an example, it analyses the limits of the appellate court instruction to the trial court and places the problem that arose in the Tempel case in the context of the current case law of the Constitutional Court.en
