dc.description.abstractTématem diplomové práce je Dispozice mortis causa v římském právu v komparaci s občanským zákoníkem. Po úvodu následují dvě hlavní části diplomové práce - Dispozice mortis causa v římském právu a v českém právu. První část diplomové práce je zaměřena na římské dědické právo. Po úvodu do římského dědického práva následuje kapitola věnovaná závěti, jejím náležitostem, formám a možnostem jejího zrušení. V první části diplomové práce je dále popsán institut odkazu a jeho druhy, fideikomis, kodicil a v neposlední řadě institut darování pro případ smrti. V této části diplomové práce jsou informace založeny na konkrétních římskoprávních pramenech a odborné literatuře. Druhá část diplomové práce je věnována současné dědické právní úpravě České republiky. Tato druhá část se zaměřuje na vyhledání jednotlivých vlivů římského práva v oblasti dědického práva v českém právu. Tato část obsahuje popis a srovnání závěti, odkazu, kodicilu a darování pro případ smrti. Oproti první části je poslední kapitola věnována dědické smlouvě. Kromě odborné literatury a zákonů se informace v této části práce opírají také o judikaturu českých soudů. Diplomovou práci pak uzavírá shrnutí poznatků získaných z analýzy daných institutů pro případ smrti a jejich vzájemné srovnání.cs
dc.description.abstract-translatedThe theme of the Diploma thesis is Disposition of mortis causa in Roman law compared with the Civil Code. There are two main parts of the Diploma thesis following after the introduction - Disposition of mortis causa in Roman law and in the Czech law. The first part of the Diploma thesis is focused on the Roman law of inheritance. After an introduction to Roman law of inheritance, there is a chapter devoted to will, its formalities, forms and the possibilities of its annulment. The first part of the Diploma thesis also describes the institution of legacy and its types, fideicommissum, codicil and last but not least the institution of testamentary gift. In this part of the Diploma thesis, the information is based on specific Roman law fragments and professional literature. The second part of the Diploma thesis is devoted to the current inheritance legislation of the Czech Republic. This second part is focused on the search for individual influences of the Roman law in the field of inheritance law in Czech law. This part contains a description and comparison of will, legacy, codicil and testamentary gift. Compared to the first part, the last chapter is devoted to the contract of succession. In addition to professional literature and laws, the information is also based on the case law of Czech courts. The Diploma thesis then concludes with a summary of the findings obtained from the analysis of the given institutes in case of death and their mutual comparison.en
