dc.description.abstractDiplomová práce se zabývá zásadou autonomie vůle v judikatuře Ústavního soudu České republiky. V teoretické části popisuje obecné rysy a charakteristiky právních zásad, jejich funkce i klasifikaci v českém právním řádu. Následně se věnuje historickému vývoji až po současné pojetí právní zásady autonomie vůle, zejména v novém občanském zákoníku a ústavním pořádku. Druhá část práce se věnuje analýze zásady autonomie vůle ve vybraných nálezech a usneseních Ústavního soudu České republiky, kterou tímto interpretují vůči ústavnímu pořádku. Cílem práce je analyzovat tuto zásadu z hlediska důležitosti, ústavní ochraně a deklarovat zásadní roli Ústavního soudu při ochraně svobodné vůle jednotlivce.cs
dc.description.abstract-translatedThe thesis deals with the principle of autonomy of will in the case law of the Constitutional Court of the Czech Republic. In the theoretical part it describes the general features and characteristics of legal principles, their functions and classification in the Czech legal system. It then discusses the historical development up to the current concept of the legal principle of autonomy of will, especially in the new Civil Code and the constitutional order. The second part of the thesis is devoted to the analysis of the principle of autonomy of will in selected judgments and resolutions of the Constitutional Court of the Czech Republic, which are interpreted in this way in relation to the constitutional order. The aim of the thesis is to analyse this principle in terms of its importance, constitutional protection and to declare the fundamental role of the Constitutional Court in the protection of the free will of the individual.en
