Základy práva požární ochrany - vývoj, teorie a praxe

Abstract

Příspěvek jezaměřen na současné, ale i minulé pojetí požární ochrany vprávní úpravě. Zaměření bude na pojetí historické, tedy od doby ohňových patentů zdoby císařovny Marie Terezie a císaře Josefa II, přesprávní úpravu zaměřenouna české země, až po vznik Československa. Následně jepopsánaprávní úprava za doby Československé republiky, ve vztahu kjeho pojetí a filosofii přijímání této právní úpravy a praktičnosti této právní úpravy.Pojednání jezaměřeno nejen na filosofii a pojetí právní úpravy, alei na zásahovou činnost, kompetence požárních sborů a jejich organizaci. Jistě se nejedná o podrobný popis, ale spíše o systematický popis vývoje právní úpravy.Vneposlední řadě pojednání posoudí předešlou a současnou právní úpravu zhlediska své komparace a vyhodnotí de lege ferenda.

The contribution focuses both on the current and past concepts of fire protection in legal regulations. The focus will be on the historical concept, starting from the era of fire patents from the time of Empress Maria Theresa and Emperor Joseph II, throughlegal regulations focused on the Czech lands, to the establishment of Czechoslovakia. Subsequently, the legal regulation during the time of the Czechoslovak Republic is described, in relation to its concept and philosophy of adopting this legal regulationand its practicality. The discussion focuses not only on the philosophy and concept of legal regulation but also on the intervention activities, competencies of fire brigades, and their organization. It is certainly not a detailed description but rather asystematic description of the development of legal regulation. Last but not least, the discussion will assess the previous and current legal regulation in terms of its comparison and evaluate de lege ferenda.
